Welcome to Haize. These Terms of Service ("Terms") govern your access to and use of Haize ("Haize," "we," "us," or "our") including our website, web application, profiles, and NFC-enabled products (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, you may not use the Services.
1. About Haize
Haize is a SaaS platform that provides tools for modern professionals and small businesses to build a public profile, capture leads, send email campaigns, accept bookings and payments, manage customer relationships, and connect physical NFC products to their digital presence.
2. Eligibility & Accounts
You must be at least 18 years old and capable of forming a legally binding agreement to use Haize. By creating an account, you represent that all information you provide is accurate and current.
Account security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@joinhaize.com if you suspect unauthorized access.
Account termination
We may suspend or permanently terminate accounts that violate these Terms, engage in fraudulent or abusive behavior, or otherwise pose risk to Haize or other users.
3. The Services
Profile & storefront
Haize allows you to create a publicly accessible profile and storefront. You control what information is displayed. You acknowledge that content you publish on your profile is visible to anyone who accesses it via link, QR code, or NFC tap.
Email campaigns & automations
Haize provides tools to send one-time email campaigns and automated email flows to your contacts. By using these features, you agree to:
- Only send emails to contacts who have consented to receive communications from you
- Comply with all applicable anti-spam laws, including CAN-SPAM and, where applicable, CASL
- Include a valid physical address and functioning unsubscribe mechanism in every email
- Not use Haize's email infrastructure to send unsolicited, misleading, or harmful messages
- Honor unsubscribe requests promptly — Haize processes these automatically
Haize reserves the right to suspend email sending privileges for accounts that generate high spam complaints, bounce rates, or violate the above terms.
AI-powered features
Haize offers AI-powered tools including a Customer Service AI agent that can be trained on your content to respond to visitors on your behalf. By using these features, you agree that:
- You are responsible for the accuracy and appropriateness of any knowledge base content you provide to train the AI
- Haize may use aggregated, de-identified interaction data to improve AI performance across the platform
- AI responses are generated automatically and may not always be accurate — you are responsible for reviewing and configuring AI behavior appropriately
- You will not use AI features to deceive, mislead, or harm users or third parties
NFC products
Haize offers physical NFC-enabled products (cards, stickers, accessories) that link to your Haize profile when tapped. You are responsible for activating and managing your NFC products through your account. If a card is lost or stolen, you must disable it immediately via your account settings. Haize is not liable for unauthorized use of NFC products prior to deactivation.
Commerce, bookings & subscriptions
Haize enables you to sell products, accept service bookings, and set up recurring subscription billing for your customers through integrations with Stripe. When using commerce features:
- You are the seller of record for all transactions with your customers
- You are responsible for accurately describing products and services, fulfilling orders, and handling customer disputes
- Haize charges a transaction fee on sales processed through the platform (varies by plan)
- Payments are processed by Stripe — you agree to Stripe's Terms of Service in addition to these Terms
- Haize is not responsible for Stripe service outages, holds, or disputes between you and your customers
CRM & contact management
Haize provides contact management tools that aggregate leads from forms, NFC taps, email signups, and manual entry. You are responsible for ensuring you have appropriate legal basis to store and contact the individuals in your CRM, and for complying with applicable privacy laws in your jurisdiction.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Send spam, unsolicited messages, or bulk communications without consent
- Upload or distribute malware, viruses, or harmful code
- Impersonate any person or entity or misrepresent your affiliation
- Scrape, crawl, or extract data from the platform without authorization
- Interfere with or disrupt the integrity or performance of the Services
- Attempt to gain unauthorized access to any part of the Services
- Use the Services for any unlawful, fraudulent, or harmful purpose
- Facilitate or promote illegal activities of any kind
Haize reserves the right to investigate and take appropriate action against violations, including removing content, suspending accounts, and reporting to law enforcement where required.
5. Your Content
You retain ownership of all content you upload, publish, or create through Haize ("Your Content"). By using the Services, you grant Haize a limited, non-exclusive, worldwide, royalty-free license to host, display, transmit, and operate Your Content solely as necessary to provide the Services to you.
You represent that you have all necessary rights to Your Content and that it does not infringe any third-party intellectual property rights or violate any laws.
Haize does not claim ownership of Your Content and will not use it for advertising or other commercial purposes beyond operating the Services.
6. Payments & Subscriptions
Platform subscriptions
Access to certain Haize features requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except where required by applicable law.
Plan changes
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the end of your current billing period.
Failed payments
If a payment fails, we will notify you and may suspend access to paid features until payment is resolved. After a reasonable grace period, we reserve the right to downgrade or terminate your account.
NFC hardware
NFC product purchases are one-time transactions. All hardware sales are final unless the product arrives defective, in which case contact us within 14 days of receipt.
7. Intellectual Property
The Haize name, logo, platform design, features, and all associated intellectual property are owned by Haize and protected under applicable law. Nothing in these Terms grants you any right to use Haize's trademarks, logos, or branding without prior written consent.
8. Third-Party Services
Haize integrates with third-party services including Stripe (payments), Mailchimp, ConvertKit (email), and others. Your use of these integrations is subject to the respective third-party terms and privacy policies. Haize is not responsible for the practices, availability, or actions of third-party services.
9. Analytics & Data
Haize provides analytics including profile views, NFC tap events, email performance, and revenue data. These metrics are provided for informational purposes. Minor discrepancies may occur due to technical factors and do not constitute a breach of these Terms.
10. Service Availability
We aim to provide a reliable, high-availability platform, but we do not guarantee that the Services will be uninterrupted, error-free, or available at all times. We may perform maintenance, updates, or modifications that temporarily affect availability. Where possible, we will provide advance notice of planned downtime.
Haize reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Haize does not warrant that the Services will meet your specific requirements or that results obtained through the Services will be accurate or reliable.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Haize and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business interruption — arising out of or in connection with your use of or inability to use the Services, even if advised of the possibility of such damages.
In no event shall Haize's total liability to you for all claims exceed the total amount you paid to Haize in the 12 months preceding the claim. This limitation applies to the fullest extent permitted by applicable law.
13. Indemnification
You agree to indemnify and hold harmless Haize and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of the Services, Your Content, your violation of these Terms, or your violation of any third-party rights.
14. Governing Law & Disputes
These Terms are governed by the laws of the United States and the state in which Haize is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice within the platform. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
